RESUMEN: Los cambios en la nueva concepción del Estado Democrático de Derecho que surgen a partir de la toma de conciencia de la existencia de determinados derechos que se consideran como fundamentales por la comunidad internacional, influyen de modo directo en el diseño de políticas públicas, de creación de normas jurídicas y en el modo de resolver los casos judiciales. Es así que se presenta a la Teoría Neoconstitucional como una nueva teoría del derecho que permite integrar los derechos con (...) sus respectivas garantías, y que se ocupa tanto de las normas como de los principios y los valores de Derechos Humanos y de su internalización en los ordenamientos de los Estados, es decir, se ocupa del fenómeno de mundialización de estos derechos. Dentro de los derechos fundamentales encontramos los que poseen las mujeres en lo que concierne a vivir una vida libre de toda violencia en la que se respete su dignidad y autonomía de la voluntad, amén de que los índices de violencia contra ellas aumentan día a día en todos los países del mundo. De este modo los Estados deberán cumplimentar con las medidas de acciones positivas tendientes a garantizar el efectivo goce de los derechos reconocidos por los Pactos internacionales de Derechos Humanos.ABSTRACT: The changes in the new conception of the Democratic State of Law that arise from the awareness of the existence of certain rights that are considered fundamental by the international community, have a direct influence on the design of public policies, the creation of legal norms and how to solve judicial cases. This is how the Neoconstitutional Theory is presented as a new theory of law that allows integrating rights with their respective guarantees, and that deals with both the norms and the principles and values of Human Rights and their internalization in the legal systems. of the States, that is, deals with the phenomenon of globalization of these rights. Within the fundamental rights we find those that women possess in what concerns to live a life free of all violence in which their dignity and autonomy of the will is respected, in addition to that the indices of violence against them increase every day in all the countries of the world. In a range of peace process scenarios, the expert’s knowledge has become a fundamental tool for generating information systems as a mechanism for the storage and circulation of data. These information artifacts are supposed to faithfully document situations of human rights violations and contribute to the design of public policy and the construction of collective memory. Following Latour’s (1993) original coinage of the term coproduction, this paper analyzes how the Inter-Institutional System of Information for Justice and Peace (SIIJYP)1 was designed (...) to define victims of war and means of reparation from the State in Colombia. From an actor network theory perspective, we explain how victimizers become the main beneficiaries of the application of the SIIJYP. To comprehend this unintended social impact of the technological artifact and how it becomes an artifact that functions as an aseptic mediator of the historical-judicial truth, and the policy of transitional justice, we examine the relations between human and nonhuman actors, how information is collected, organized, hierarchized, and negotiated, as well as the consequences of the technical and legal construction of the notion of victims of war. Este artículo pretende examinar la particular repercusión de Ifigenia en el debate de la _Querelle des femmes_ a partir de la recuperación del manuscrito de la tragedia de Eurípides a finales del s. XV, en autores como Galeazzo Flavio Capra, Ludovico Dolce o Lilio Gregorio Giraldi. La recepción de la tragedia griega desde Italia, al verterse en dramas (...) y tratados, irradió en la cultura moderna europea nuevos emblemas sobre la condición femenina, hacia un modelo de virtud cuya moral supera la crueldad de los dioses y los hombres, pues lucha por su propia libertad y dignidad. This paper analyzes the development of the Ciceronian topos historia magistra vitae in the work of Niccolò Machiavelli in so far as it brings into play a concept of history which is not involved in the didactic-moralizing role of the humanist tradition, in such a way that the exemplarity of the histories emerges as an essential element for the configuration of an arte dello stato . This formulation of the commonplace in his work is linked to a critical approach to (...) the imitation of ancient times and the examples collected in histories through a double articulation that places him in an eclectic position between classicism and novelty. This paper addresses two central issues: the first one briefly presents two stages of anthropological development of Paul Ricoeur’s anthropologic deployment, as an effort to think human being with a renewed logic. The second one states that in such philosophical journey a plus of meaning is inserted into the language of faith which accompanies the anthropological development itself and, in turn, exceeds and contains the philosophical specific task, and also makes clear how such an assignment exceeds the explicit aims of (...) the French author. In other words, this paper only seeks to outline a ‘gesture of openness’ in contemporary philosophy, accepting its heritage, and assuming renewed hues, deeps and scopes, allowing the philosophical work and human being go beyond themselves. El trabajo con las arquitecturas vinculadas a hechos de violencia, muerte y desaparición posee una complejidad que es propia. En el caso de los “ex” CCD en nuestro país, esta complejidad supuso numerosos debates y discusiones respecto de cómo llevar adelante la institucionalización de Espacios para la Memoria en estos lugares desarrollando intervenciones que respetaran las características materiales de las arquitecturas al tiempo que permitieran la construcción de memoria.Con el objetivo de indagar las definiciones construidas en relación con la materialidad (...) y su vínculo con la construcción de memorias en el caso del “ex” CCD Virrey Cevallos, en Ciudad Autónoma de Buenos Aires, en este artículo tomamos en consideración las tareas de conservación y restauración que se llevan adelante, las tensiones que emergen en la tarea y las sectorizaciones espaciales que se configuran. ¿Cómo se trabaja con la materialidad del “ex” CCD? ¿Cuáles son las estrategias asumidas desde la intervención en su materialidad? O en todo caso, ¿qué aspectos se consideran para definir una intervención? Usually, the organization of living systems is explained by appealing to an intrinsic purpose that is based on the biological survival. However, paradigmatically, it is inevitable to observe that the final destiny of all living organisms is death. In this work, we defend that, from an organizational approach, there is a form of death—Regulated Cell Death—that, far from being a mere «absence of life», is a process of biological regulation and a feature of self-maintenance in multicellular organisms.

Resumen: El artículo busca observar el hecho religioso mapuche, a partir de la reflexión de Rudolf Otto respecto de lo numinoso y lo santo. Para ello se utiliza su metodología de análisis fenomenológico aplicada a los conceptos de mysterium, tremendum y fascinans o las dimensiones del temor, incorporadas en la cultura mapuche. Se concluye que el análisis de estos diversos momentos de la experiencia santo-numinoso en la vida religiosa del mapuche, permite constatar el dinamismo existente en la idea religiosa del (...) mapuche, lo que a su vez representa adecuadamente la relación entre el hombre religioso y lo santo.: This article seeks to observe the Mapuche religious fact, starting from Rudolf Otto’s reflection on the numinous and the holy. For this, it uses its methodology of phenomenological analysis applied to the concepts of mysterium, tremendum and fascinans or the dimensions of fear, incorporated in the Mapuche culture. The question about the subject involves us in different kinds of problematics that seem irresolvable, however, the subject in his own inquiry about himself can expose and communicate them. The affairs that interpellate the subject clearly refer the individual self but this self is-being in life and is able of self-recognizing in its relation to the world. In this study, following Edgar Morin, we will try to show that the subject is simultaneously con-formed in a web which is both social (...) and individual and that it must be considered in this way to be understood. Este artículo tiene por objetivo, por una parte, buscar y presentar un diálogo enriquecido entre los conceptos de atestación y sospecha provenientes de la hermenéutica desarrollada por el filósofo Paul Ricoeur, y, por otra parte, intentar mostrar que dicho modelo o paradigma dialógico es capaz de oficiar de fuente hermenéutica transversal a las humanidades, y en concreto a la literatura. Esto es así en la medida en que implicaría una herramienta gnoseo-epistemológica válida de análisis en la cual se asume la (...) duda y la sospecha, pero al mismo tiempo se las atraviesa y trasciende hacia una renovada afirmación ontológico-existencial decisiva y restaurada. La propuesta se detiene en analizar el eco del pensamiento utópico de Ernst Bloch presente en los ensayos de Christa Wolf “Der Schatten eines Traumes. Karoline von Günderrode -ein Entwurf” (1978) y “Nun ja! Das nächste Leben geht aber heute an. Ein Brief über die Bettine” (1979). Asimismo, se profundizará la caracterización del romanticismo de Wolf como revolucionario utópico, que implica una crítica a la Modernidad y a la civilización capitalista y que está ligado al feminismo.

Social work is assumed as transdisciplinary and because of that the aim of this paper is to reflect about the complex foundations of intervention theory, constructed from an organic and consistent profession. The idea is to contribute to the creation of a corpus that overcomes the technological tradition responding to three challenges: the creation of inclusive and collaborative processes with subjects, the transformation of diagnosis and intervention techniques in research resources, and the inclusion of symbols as an inseparable dimension from (...) everyday practices and social structures of the subjects of study and intervention. Desde el trabajo social asumido como transdisciplina se pretende reflexionar sobre las bases complejas necesarias para abrir caminos hacia una teoría de la intervención, construida desde una investigación coherente y orgánica a la profesión. La idea es aportar a la conformación de un corpus que supere y asuma la tradición tecnológica dando respuesta a tres desafíos: la conformación de procesos investigativos inclusivos y colaborativos con los sujetos, la reversibilidad de técnicas de diagnóstico e intervención en recursos de investigación, e incluir lo simbólico como dimensión fundamental e inseparable de las prácticas cotidianas y las estructuras sociales de los sujetos de estudio e intervención del trabajo social. Resumen: La novela epistolar Caro Michele [1973], de Natalia Ginzburg, aborda, como varias de las obras tardías de la autora, la decadencia de la pequeña burguesía y de la estructura tradicional de familia. Desarrollaremos la presencia de la melancolía en la novela ligada a su componente crítico. También nos proponemos analizar una reflexión acerca del lugar que ocupa la militancia del protagonista y la política como un objeto de deseo perdido en la obra.: Natalia Ginzburg’s epistolary novel Caro Michele [1973] (...) addresses, like several of the late works of the author, the decadence of the petty bourgeoisie and the crisis of the traditional institution of the family. We will develop the presence of melancholy in the novel linked to its critical component. ABSTRACTThe notion of metaphor has been broadly discussed during the twentieth century as an essential and necessary part of language and history. This article examines the theoretical dialogue that links the centrality of the metaphor of light in the work of María Zambrano with reflections on this topic by Jacques Derrida and Hans Blumenberg. Through various formulations of this metaphor across different works, Zambrano presents the metaphor linked to poetic reason as not reducible to a mere rhetorical ornament or (...) to a concept. By articulating alternative metaphors to the imperative of clarity as the blinding light of Occidental reason, Zambrano introduces a solid critique to rationalism and introduces the metaphor of the Dawn as a new form of knowledge. This new intonation of the metaphor of light opens up an unexplored direction in Spanish thought not only by thinking the metaphor of light through poetic reason and its critique to the philosophical tradition, but also by assuming the political implications of this metaphor and criticizing its heliopolitical configuration. Indeed, Zambrano states the significance of the metaphor of the sun linked to the sacrificial structure of history, particularly of Spain, and its necessary overcoming as the possibility of a radical democracy. En este trabajo, analizamos los efectos de los regímenes extractivistas en los territorios y los cuerpos desde el lugar situado de las mujeres. Centramos el análisis en la ciudad de Allen (Río Negro), a partir de la conversión de su territorio frutícola en área de extracción de hidrocarburos no convencionales. Hipotetizamos que la gubernamentalidad neoliberal que se impone en estos territorios arrasados genera una crisis de la reproducción social que impacta en el trabajo vivo útil para la producción y reproducción (...) de la vida humana; y que son las mujeres, en tanto subjetividades históricamente subalternizadas y relegadas a la esfera reproductiva, quienes pueden dar cuenta de los despojos del extractivismo desde miradas que trascienden las dicotomías de la modernidad: público / privado, Estado / mercado, productivo / reproductivo. Nos situamos en la epistemología feminista para analizar las narrativas de mujeres que habitan territorios de despojo desde los cuales ellas hacen posible la vida. Nos interesa aportar al conocimiento de los efectos de los regímenes extractivistas desde la producción y circulación de sentidos “otros” acerca de sus impactos, construidos en las intersecciones de género, clase y territorio. A partir de rondas de entrevistas bajo la modalidad de autorrelato, planteamos una reconstrucción genealógica de la memoria larga de la experiencia en estos territorios que habilita a lecturas sobre el extractivismo. Para ello nos valemos de un diseño de tipo flexible y de un procedimiento intensivo que nos permite un ida y vuelta no lineal entre la complejidad del campo y la teorización. Como apuesta metodológica buscamos darles contenido político a las experiencias invisibilizadas, pensando la palabra como medio de transformación y terreno de disputa. Nos interesa aportar al conocimiento de los efectos de los regímenes extractivistas desde la producción y circulación de sentidos “otros”, construidos en las intersecciones -de género, clase, territorio- desde las cuales se vivencian y construyen oposiciones a la ofensiva extractivista. El artículo presenta una lectura sobre la enseñanza de la filosofía en el nivel secundario de la República Argentina. A tal fin, se hace una periodización a partir de aspectos del contexto socio-histórico-político considerados centrales por su impacto sobre esta y de las normativas que la regularon. Este análisis de la historia nacional —desde mediados del siglo XIX a la actualidad— se sustenta en la concepción de que la enseñanza de la filosofía solo es posible desde una situacionalidad y que, (...) por un lado, la omisión de la misma no hace más que desconocer la complejidad que aporta cada contexto a esta tarea y, por otro, habilita a pensar las condiciones actuales como instancias de un proceso mucho más amplio. Resumen: Tenemos ante nosotros un trabajo social con pretensiones de disciplina que se ve atrapado entre sus utopías y sus tecnologías integradas en dispositivos de poder y que, consideramos, podría tomar mayor control de sus propias posibilidades si se auto-observa como sistema que produce y reproduce culturas compartidas y relaciones socio-políticas. En el siguiente artículo, deseamos dirigirnos hacia la construcción de epistemologías para la aproximación analítica de las intervenciones y las acciones sociales del trabajo social desde parámetros socio-críticos y complejos, (...) a través de la consideración de las intervenciones sociales como culturas políticas. El fin de esta reflexión es favorecer vías de comprensión de la práctica de intervención de forma integral, en interdependencia con lo macro social, para lograr cumplir con la necesaria tarea de nutrir reflexivamente las dimensiones del trabajo social.: Social work as discipline is trapped between utopias and technologies integrated in devices of power and, we propose, could take more control of its own possibilities if it is self-observed as a system which produces and reproduces shared cultures and socio-political relations. In the following article, we focus on the construction of epistemologies for the analytical approximation of interventions and social actions of social work from socio-critical and complex parameters. We make this approach through the consideration of social interventions as political cultures. The purpose of this paper is proposing ways of understanding intervention as practice in an integral way, in interdependence with the macrosocial context, to achieve the necessary task of to feed, reflexively, the dimensions of social work. Una de las características que asumieron las epidemias a lo largo de la historia fue el desarrollo de manifestaciones populares a fin de combatirlas o, por lo menos, atenuar el impacto que generaban en términos de mortalidad y morbilidad. Las procesiones constituyeron un ejemplo de dichas intenciones que, en muchos casos, fueron aprovechadas por la Iglesia a fin de generar capital político. Estas manifestaciones fueron, en su mayoría, en contra de las medidas que desde los sucesivos gobiernos se pretendían imponer (...) a los fines de combatir las dolencias. Pero en otros, las epidemias constituyeron catalizadores de problemáticas de amplio espectro y las políticas públicas que se generaron en torno a ellas fueron causa de reacciones que poco tenían que ver con la religión. En el presente artículo nos proponemos analizar, a partir de los periódicos de la época, las repercusiones y respuestas sociales que generaron determinadas políticas públicas, suscitadas a partir de la crisis que forjó la epidemia de gripe española en los años 1918-1919 en tres puntos de la Argentina con características políticas, económicas y socio-demográficas particulares: en las ciudades de Buenos Aires, Córdoba y Salta. Following the declaration of the COVID-19 outbreak as a global pandemic in March 2020, a state of alarm was decreed in Spain. In this situation, healthcare workers experienced high levels of stress, anxiety and depression due to the heavy workload and working conditions. Although Spain experienced a progressive decline in the number of COVID-19 cases until the last week of May and the work overload among health workers was substantially reduced, several studies have shown that this work overload is associated (...) with the later emergence of psychological symptoms induced by stress. The aim of the present study was to evaluate the levels of stress, anxiety, depression, post-traumatic stress and compassionate fatigue in health professionals. The sample consisted of 973 health professionals 16.5% men, 82.9% women, and one non-binary person. The data were collected through an online questionnaire sent to the participants by e-mail. DASS-21 was used to measure anxiety, stress and depression, PCL-C to measure post-traumatic stress and ProQOL -vIV to measure compassion fatigue. In addition, other descriptive variables that could be related to these levels of psychological symptomatology were evaluated. The results reveal that after the work overload experienced during the COVID-19 pandemic, healthcare workers report psychological symptoms, post-traumatic stress and compassion fatigue. It is therefore recommended that these professionals be provided with psychological help in order to reduce the emotional impact of COVID-19, and consequently improve their mental health. (shrink)

Incest taboos are universal, but it is questionable whether consensual incest should continue to be illegal. The most common argument in favor of the illegalization of consensual incest appeals to genetic risks and the harm to potential offspring. In this article, we examine whether public health concern is a sufficient reason to illegalize consensual incest. We posit that indeed, incest represents a risk, but this is not reason enough to illegalize incest. For, other circumstances of sexual intercourse may lead to (...) similar risks, and yet, such practices are not illegal. While those practices may represent an added risk to public health, to forbid them as a way to improve the genetic pool would be akin to eugenic program, and that is morally objectionable. This does not imply that consensual incest ought to be legal, for there may be other good reasons to illegalize it. But they do not relate to public health and genetic risks, and consequently, medical practitioners and public health officials ought to avoid using their medical authority as a platform to make moral pronouncements. IntroductionThe prefrontal cortex plays a crucial role in cognition, particularly in executive functions. Cortical reactivity measured with Transcranial Magnetic Stimulation combined with Electroencephalography is altered in pathological conditions, and it may also be a marker of cognitive status in middle-aged adults. In this study, we investigated the associations between cognitive measures and TMS evoked EEG reactivity and explored whether the effects of this relationship were related to neurofilament light chain levels, a marker of neuroaxonal damage.MethodsFifty two healthy middle-aged adults from (...) the Barcelona Brain Health Initiative cohort underwent TMS-EEG, a comprehensive neuropsychological assessment, and a blood test for NfL levels. Global and Local Mean-Field Power, two measures of cortical reactivity, were quantified after left prefrontal cortex stimulation, and cognition was set as the outcome of the regression analysis. The left inferior parietal lobe was used as a control stimulation condition.ResultsLocal reactivity was significantly associated with working memory and reasoning only after L-PFC stimulation. No associations were found between NfL and cognition. These specific associations were independent of the status of neuroaxonal damage indexed by the NfL biomarker and remained after adjusting for age, biological sex, and education.ConclusionOur results demonstrate that TMS evoked EEG reactivity at the L-PFC, but not the L-IPL, is related to the cognitive status of middle-aged individuals and independent of NfL levels, and may become a valuable biomarker of frontal lobe-associated cognitive function. IntroductionExcitability of the primary motor cortex measured with TMS has been associated with cognitive dysfunctions in patient populations. However, only a few studies have explored this relationship in healthy adults, and even fewer have considered the role of biological sex.MethodsNinety-seven healthy middle-aged adults completed a TMS protocol and a neuropsychological assessment. Resting Motor Threshold and Long-Interval Intracortical Inhibition were assessed in the left motor cortex and related to attention, episodic memory, working memory, reasoning, and global cognition composite scores to evaluate (...) the relationship between cortical excitability and cognitive functioning.ResultsIn the whole sample, there was a significant association between LICI and cognition; specifically, higher motor inhibition was related to better working memory performance. When the sample was broken down by biological sex, LICI was only associated with working memory, reasoning, and global cognition in men. No associations were found between RMT and cognitive functions.ConclusionGreater intracortical inhibition, measured by LICI, could be a possible marker of working memory in healthy middle-aged adults, and biological sex plays a critical role in this association. Juan de Vera’s El Enbaxador (1620) was one of the main treatises on the role of the ambassador in Early Modern Europe and the first one published in Spanish. At the time, Spain was no exception to the influence of Tacitus as a significant ancient author to inspire the political practice of the age. Juan de Vera, a nobleman and writer, soon an ambassador and entitled count, incorporated his own reading of Tacitus into El Enbaxador. Justus Lipsius, the outstanding editor (...) of Tacitus’ works, was also a main source for this book which was defined by John Elliott as a ‘quintessentially Lipsian handbook for diplomats’. The focus of this article is on Tacitus’ citations in El Enbaxador and their contexts within the book. My aim is to identify the specific themes for which Tacitus served as an exemplary source of guidance according to this particular text. Notably, some of such themes pertain to ambassadorial affairs, while others are common political topics in Early Modern Europe. Vera's reading of Tacitus in El Enbaxador gained wider dissemination beyond Spain as the work was subsequently translated into French and Italian. (shrink)

The first part of this work analyses the universalist and the particularist conceptions of reasons. The second part projects this analysis to the legal domain. The author stresses that universalism and particularism regarding reasons are mutually exclusive theories linked to incompatible conceptions of norms, i.e. norms as strict universal conditionals and norms as defeasible conditionals. In giving an account of this tenet, different meanings of universality and defeasibility are explored. A parallel debate regarding reasons can be found in the legal (...) domain, where two contrasting categories of norms are usually distinguished: rules and principles. On this issue the author argues that the conception of legal reasons depends on the way in which this contrast between different kinds of legal norms is shaped. (shrink)

In 1989, Thomas Donaldson requested the California courts to allow physicians to hasten his death. Donaldson had been diagnosed with brain cancer, and he desired to die in order to cryonically preserve his brain, so as to stop its further deterioration. This case elicits an important question: is this a case of euthanasia? In this article, we examine the traditional criteria of death, and contrast it with the information-theoretic criterion. If this criterion is accepted, we posit that Donaldson’s case would (...) have been cryocide, but not euthanasia. We then examine if cryocide is an ethically feasible alternative to euthanasia. To do so, we rely on the ethical doctrine of double effect. (shrink)

En este artículo pretendemos dar cuenta del desenvolvimiento que tuvo la filosofía moderno-contemporánea y el llamado pensamiento postmetafísico, a partir de Edmund Husserl. Alrededor las categorías fenomenológicas de método y de sentido enunciamos un gesto de apertura a la filosofía contemporánea la cual asume distintos matices que pretenden que la actividad filosófica vaya más allá de sí misma.

BackgroundThis study analyzed the difference in psychological distress of the healthcare workers in three different periods of the coronavirus disease 2019 (COVID-19) pandemic in Argentina. Specifically, from the third week of the mandatory quarantine through the two following weeks.MethodsAnalysis of the responses of 1,458 members of the health personnel was done on a questionnaire on healthcare workers concerns regarding the care of patients with coronavirus, indicators of depression, anxiety, intolerance of uncertainty, and coping.ResultsThe psychological indicators that were considered presented differences (...) between the evaluated periods. Perceived concerns about the possibility of infecting loved ones and infecting themselves were greatest in the periods after the onset of the pandemic. In addition, the perception of how the work environment worsened and how lack of sleep interfered with their work was also higher in periods 2 and 3. The same results were found in the indicators of depression, anxiety, and intolerance of uncertainty. Finally, the indicators of high tension and concurrent lack of emotional control, which was greater in the last periods evaluated, were also expressed in the coping strategies (showing emotional lability, only contained by hypercontrol).ConclusionThe differences found in the psychological indicators between the evaluated periods support the need for early psychological care of health personnel which should be a priority of public health and a fundamental fact to increase its immediate effectiveness in the care of infected patients.
